The Public Procurement, Assets and Disposal Regulations 2020 commence

On 2nd July 2020, The Public Procurement, Assets and Disposal Regulations 2020  came into force. The Secretary for Finance & Planning made the announcement vide a gazette notice published on 24th July 2020. The regulations are meant to operationalise The Public Procurement, Assets and Disposal Act 2015.

Key features include:-

  1. The Act will not apply to Bilateral & Multilateral Agreements involving negotiated loans for which the procurement procedures has been identified in the agreement.
  2. The National Treasury has been given the mandate of training and capacity building in procurement.
  3. The National Treasury shall publish a list of Common user item annually.
  4. The Review Board is to ensure accessibility of its services to all parts of Kenya.
  5. The regulations pertaining to a debarment of a supplier
  6. Use of e-tendering
